1. Scope
These Terms & Conditions apply to all orders placed through the online shop wellthestore.com ("well", "we", "us") by customers ("you"). By completing an order, you accept these terms. Any deviating terms proposed by the customer will not apply unless we agree to them expressly and in writing.
2. Provider
well the store GmbH Im Gsteig 18 8700 Küsnacht Switzerland UID: CHE-220.655.843 Email: contact@wellthestore.com
3. Subject of the Contract
well operates a curated online store for supplements, clean beauty, and functional nutrition products. We act as a reseller of third-party brand products that meet our internal selection criteria ("The Well Standard"). We are not the manufacturer of the products offered unless expressly stated otherwise.
4. Formation of Contract
The display of products in the online shop does not constitute a binding offer, but an invitation for you to place an order. By submitting your order through checkout, you make a binding offer to purchase. The purchase contract is formed once we expressly accept your order — via a confirmation email or by shipping the goods. We reserve the right to decline orders without stating a reason, in particular in cases of payment failure, suspected misuse, or unavailability of stock.
5. Prices
All prices shown on wellthestore.com are in Swiss francs (CHF) and, where legally applicable, include value-added tax (VAT/MWST). Shipping costs are shown separately before you complete your order. We reserve the right to change prices at any time; the price shown at the time of ordering applies.
6. Payment
Payment is made using the payment methods shown at checkout. The invoice amount is due immediately upon ordering, unless stated otherwise. In the event of late payment, we are entitled to cancel the order or withhold shipment.
7. Delivery & Shipping
Deliveries within Switzerland are made via DHL. Delivery dates are non-binding estimates unless explicitly stated as binding. Risk of accidental loss or damage passes to the customer upon handover of the goods.
8. Retention of Title
Delivered goods remain the property of well the store GmbH until paid in full.
9. Returns & Refunds
All sales are final. Under Swiss law, no statutory right of withdrawal applies to this contract (unlike, for example, EU consumer law), unless we voluntarily grant one.
If your order arrives damaged or a product is defective, contact our customer support team within 7 days of delivery with your order number, photos of the damaged item and packaging, and a brief description of the issue. We will review your claim and, at our discretion, offer a replacement or refund.
10. Warranty
The statutory warranty provisions of the Swiss Code of Obligations (Art. 197 et seq. CO) apply. Defects must be reported to us without delay upon discovery, and in any case within the applicable statutory time limits.
11. Liability
We are liable only for damages caused by intent or gross negligence. Liability for slight negligence is excluded to the extent permitted by law. Our products do not replace medical advice, diagnosis, or treatment; please consult a physician for health-related questions.
12. Data Protection
Your personal data is collected and processed in accordance with our separate Privacy Policy, which complies with the Swiss Federal Act on Data Protection (FADP/DSG).
13. Intellectual Property
All content on wellthestore.com (text, images, trademarks, logos) is protected by copyright and may not be used without our prior written consent.
14. Changes to These Terms
We reserve the right to amend these Terms & Conditions at any time. The version in effect at the time of your order applies.
15. Governing Law & Jurisdiction
These terms are governed exclusively by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). To the extent permitted by law, the place of jurisdiction is the registered seat of well the store GmbH.
16. Final Provisions
Should any individual provision of these Terms & Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
